9.- APPLICABLE LAW AND COMPETENT JURISDICTION.

Nomad Coffee and users, expressly waiving any other jurisdiction that may apply, are subject to the courts and tribunals of the user's domicile for any dispute that may arise from access or use of the web. In the event that the user is domiciled outside Spain, Nomad Coffee and the user, expressly waiving any other jurisdiction, submit to the courts and tribunals of the domicile of Nomad Coffee.

LEGAL BASES OF THE RAFFLE NOMAD CHRISTMAS LOTTERY 2024

COMPANY ORGANIZING THE SWEEPSTAKES
The Company Nomad Coffee S.L. with address at Pujades 95, 08005 Barcelona and identification number B66400664 organizes for promotional purposes the sweepstakes (hereinafter "the Sweepstakes") of international scope and of legal age in accordance with the provisions of the section on conditions for participation.

9.2.-START DATE AND END DATE
THE DRAWING will begin on December 1, 2024, and will end on December 18, 2024. The winner will be announced on December 20 through Nomad Coffee's social networks.

9.3.- PARTICIPATION REQUIREMENTS AND DRAW MECHANICS
It is important to emphasize that participation in the Sweepstakes implies unconditional acceptance of and compliance with the provisions of these Terms and Conditions. The participation requirements will be the following: Participation will be open to those persons who are over 18 years of age. Only those participants who have subscribed to the Nomad coffee subscription and who are active as of December 18th will be able to participate. The mechanics of the raffle consists of randomly choosing one person from the database of all subscribers up to the indicated date. The winner will be notified on December 20, 2024.

CONDITIONS OF THE PROMOTION AND PRIZES
Only one winner will be chosen through a random selection from the entire database of subscribers to the service on December 20, 2024. The winner will receive as a prize: an 18 carat gold pendant in the shape of a coffee bean. It will be delivered with a gold chain. We will contact the winner by email where we will tell him/her how to collect the prize within 90 days from the date on which it is announced on the social profile of the brand. In the event that no such contact is made within the stipulated period, the sweepstakes will be declared void. The celebration of the sweepstakes, as well as the awarding of the prize are subject to current tax regulations.

9.5.- LIMITATIONS.
If it becomes evident that any of the participants do not meet the requirements of the Rules, or the data provided to participate were not valid, their participation will be considered void and they will be automatically excluded from the draw, losing all rights to the prizes awarded under this Promotion. The following persons may not participate in the Promotion: (i) Employees employed by any of the companies and other entities with legal personality linked to NOMAD COFFEE SL (ii) Individuals who participate directly or indirectly in the capital of NOMAD COFFEE SL (iii) Any other natural person who has participated directly or indirectly in the organization of this Sweepstakes or has been involved directly or indirectly in its preparation or development (agency, suppliers, etc.). The prize awarded will not be transferable or subject to changes, alterations or compensation at the request of the Participants, and may not be exchanged for any other product or money. NOMAD COFFEE SL reserves the right, if there is just cause and prior communication in legal form, to make any changes, suspend or extend this Sweepstakes. Shall be borne by the winner any fiscal or tax burden that the acceptance of the prize may entail, as well as any other expenses arising from the draw that is not expressly assumed by NOMAD COFFEE SL in these Legal Bases. A period of FIFTEEN (15) calendar days from the date of the awarding of the prize, to make any claim motivatedNOMAD COFFEE SL reserves, if necessary, the right to replace the prize for another of similar characteristics.

9.6.- PUBLICATION OF COMMENTS OR OPINIONS.
Comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory or that could violate the rights of third parties will not be allowed. Nor will be allowed comments against an individual that violate the principles of the right to honor, personal and family privacy and self-image. We will not be responsible for any damage caused by the comments made by the participants in the Sweepstakes, and that at any time could hurt the sensitivity of other participants. Any attempt to hinder the smooth running of the Sweepstakes either by human intervention or by means of an automaton will result in the immediate disqualification of the participant and the annulment of his/her candidacy.

9.7.- DISCLAIMER OF LIABILITY.
By way of example, but not limited to, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the participant with respect to the prize obtained from this Promotion, and do not assume any responsibility for any damage or harm of any kind that may be suffered by the Participants, winner or third parties. We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize. The sweepstakes is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram and Entrants release Facebook from any and all liability for any damages arising therefrom.

Use of Chatbase (AI Chatbot)

On this website we use an artificial intelligence based chatbot provided by Chatbase with the aim of improving customer service, resolving doubts in real time and offering a more fluid and interactive user experience.

Data protection and privacy

Conversations held through the chatbot may be recorded and processed for maintenance, service improvement, error detection and troubleshooting purposes.
Information shared through the chatbot is encrypted both in transit and at rest, and is managed in compliance with the highest security standards.
Chatbase complies with applicable data protection regulations, including:
- The General Data Protection Regulation (GDPR) (EU Regulation 2016/679).
- The SOC 2 Type II security standard, related to data management and internal controls.
